 RE:  Application for Development Permit with Variance (DVP-05-18)




Application has been received for a Development Permit with Variance for the above noted property that would vary the Highlands Zoning Bylaw No. 100, 1998 as follows:

Section 3.3 (1) c)
FROM: Despite any other provisions of the Bylaw, no part of any building or structure shall be constructed, reconstructed, moved or extended nor shall any part of any mobile home or unit, modular home or structure be located:…within 30m of the natural boundary of any other lake, pond or wetland… 

TO: Despite any other provisions of the Bylaw, no part of “Shp A” as shown on Attachment 1 to this Permit shall be constructed, reconstructed, moved or extended:…within 24.6m of the natural boundary of any other lake, pond or wetland…

AND


Despite any other provisions of the Bylaw, no part of “Fence” as shown on Attachment 1 to this Permit shall be constructed, reconstructed, moved or extended:…within 8m of the natural boundary of any other lake, pond or wetland…


AND

Section 7.3.3 (7)
FROM: The total floor area of all accessory buildings on a lot shall not exceed 525 square metres and no single accessory building shall exceed 300 square metres in floor area. 


TO: The total floor area of all accessory buildings on a lot shall not exceed 654.3 square metres and no single accessory building shall exceed 300 square metres in floor area. “Shp A” as shown on Attachment 1 to this Permit shall not exceed 312 square metres.  


The land owners are seeking to rectify bylaw non-compliance with respect to existing buildings. Part of this process includes applying for a Development Permit with Variance. Because the “Fence” is also non-compliant with the Zoning Bylaw, it forms part of the application. The subject structures were installed in the 1990’s. Approval of the Development Permit with Variance does not grant additional works, uses or density. It would allow the District to consider Building Permit Applications toward bylaw compliance. Notice is given that the Council of the District of Highlands will consider a resolution to authorize the issuance of Development Permit with Variance DVP-05-18 to allow the requested variance at a special meeting of Council scheduled for Monday, December 17, 2018 at 7:00 p.m. at the School House, 1589 Millstream Road, Highlands, BC.


If you wish to comment on the application, you are invited to make your views known in a letter (to District of Highlands, 1980 Millstream Road, Victoria, BC V9B 6H1), fax (to 250-474-3677), or by email (to LBeckett@highlands.ca ) no later than 12:00 p.m. December 17, 2018.  A copy of the Development Permit with Variance application and associated information may be inspected at the District of Highlands Municipal Office, 1980 Millstream Road, between the hours of 8:30 a.m. and 4:00 p.m., Monday through Friday, except holidays from December 5 to December 17, 2018.
